When a joint refund pays one spouse's debt

The right questions begin with whose debt caused the reduction and how the refund arose.

Start with your situation

Keep the joint return and each spouse's income and payment evidence. Do not confuse allocation of a refund with a separate question about responsibility for tax on the joint return.

Two spouse relief processes address different problems

Injured spouse relief concerns allocation of a joint overpayment applied to certain debts of the other spouse. It is different from innocent spouse relief, which concerns responsibility for tax on a joint return. Choosing a form because its name sounds familiar can send the issue down the wrong path. Review the circumstances and current IRS instructions.

Map the refund and the debt

List which spouse earned income, made payments, and is responsible for the debt described in the notice. Gather the joint return, wage statements, and offset information. Ask which process fits and what additional allocation records are needed. Do not promise a particular repayment amount before a qualified review of the facts and the applicable rules.

  • Identify whose debt caused the offset
  • Gather income and payment allocation
  • Read current Form 8379 instructions

Questions to consider

Are injured spouse and innocent spouse relief interchangeable?

No. They address different circumstances. Identify whether the problem is a refund allocation or liability for tax before choosing a process.
